The Patent Trial and Appeal Board on Friday invalidated many claims of four dietary supplement patents that Swiss Merck KgaA accused biotech firm Gnosis SpA of infringing, in what an attorney for Gnosis said may be the first inter partes review involving pharmaceutical-related patents.

Merck Unit, Pamlab Sue Over Generic Metafolin
A Swiss unit of Merck KGaA and Pamlab LLC filed suit in Texas federal court Thursday accusing Macoven Pharmaceuticals LLC and biotech firm Gnosis SpA of making generic folate supplements that infringe six patents for Merck's supplement ingredient Metafolin.
