2nd Circ. Ruling On Overseas Tipsters Dodges Big Issues
In its Thursday ruling that the Dodd-Frank Act's whistleblower protections do not cover tipsters outside the United States, the Second Circuit dodged a potentially tricky reading of the U.S. Supreme Court's Morrison decision and left completely untouched a growing dispute over whether internal reporting is covered by the law's anti-retaliation provisions.

A lawyer for a former Siemens China Ltd. compliance officer who claims he was fired in retaliation for reporting supposed kickbacks involving medical imaging equipment sales told the Second Circuit on Monday that whistleblower protections in the Dodd-Frank Act should apply overseas.

SEC Defends Internal Whistleblower Protections At 2nd Circ.
The U.S. Securities and Exchange Commission on Thursday made its case for broad whistleblower protections, telling the Second Circuit that the anti-retaliation provisions of the Dodd-Frank Act applied to both employees who internally report misconduct and those who take it to the commission.
