DC Circ. Backs FERC's OK For Southwest Grid Integration
The D.C. Circuit on Tuesday rejected a challenge by Kansas utility regulators to the Federal Energy Regulatory Commission's approval of regional grid operator Southwest Power Pool Inc.'s plan to bring aboard two utilities without having to pay certain facility costs, saying FERC's reasoning was sound.

FERC's Southwest Grid Plan OK Discriminatory, DC Circ. Told
The Federal Energy Regulatory Commission essentially gave away the farm by letting two utilities into Southwest Power Pool Inc.'s transmission footprint without having to pay certain facility costs, Kansas utility regulators complained to a D.C. Circuit panel at oral arguments Wednesday, calling FERC's approval of the integration plan "discriminatory and preferential."

The Federal Energy Regulatory Commission on Tuesday defended its approval of Southwest Power Pool Inc.'s plan to bring three utilities into the regional grid operator's transmission footprint, telling the D.C. Circuit that the utilities' integration will bring $334 million in benefits to SPP's existing members over a 10-year period.
