The Ninth Circuit on Friday affirmed a lower court's denial of a request by software company Proofpoint Inc. for exemplary damages that could have doubled its $13.5 million trade secret theft verdict, ruling that any error the district court made in denying the damages is harmless.

Proofpoint Denied Fees For $14M IP Verdict Against Rival
A California federal judge denied Tuesday software company Proofpoint's attorney fee request for scoring a $14 million trade secret theft verdict against an ex-executive and a rival that hired him, finding that the evidence supporting the jury's willful misappropriation finding is minimal "at best" and not enough to warrant fees.
