MINUTE entry before the Honorable Sunil R. Harjani: The parties' joint motion for clarification 1101 is granted. To clarify, the Court would prefer to appoint one independent expert for all three fields. If it becomes impossible to find one expert that could do so, the Court would be open to two independent experts, in which case the parties can provide six names. Having said that, if the parties are able to all agree on one or more independent experts, then the Court would be willing to consider appointing that person(s) without the need for the three-names procedure. The parties may jointly contact any proposed experts together by telephone or videoconference, which means no ex parte communications. The subject matters that may be discussed are purely background/logistical/financial, such as providing court filings, obtaining the expert's resume, the expert's interest and availability, any conflicts that would prevent them from taking the assignment, etc. Given that both parties will be on the call, the Court is confident that they will each ensure the other side does not stray into any discussion about the substance of any opinion that would be rendered by the proposed expert.
