TEXT ORDER: For the reasons stated on the record during the 7/17/2026 Motion Hearing, defendants' 160 motion to compel is DENIED, without prejudice and with leave to amend, and Plaintiff's 162 motion is GRANTED in part and DENIED in part. Plaintiff's 162 motion as to Munich Reinsurance is terminated as withdrawn. SO ORDERED by Magistrate Judge Carla B. Freedman on 7/17/2026. (nmk)

TEXT Minute Entry for Stenographically-Recorded Oral Argument held on 7/17/2026 via video before Magistrate Judge Carla B. Freedman as to the 160 , 162 and 165 Filings. Court briefly discusses the case history and the pending motion 160 Motion to Compel. The court has a lengthy discussion with counsel and allows supplemental arguments. For the reasons stated on the record the court denies the defendants' 160 motion to compel, without prejudice and with leave to amend, to allow IBM to continue to release documents and information. As the Plaintiff's 162 Motion to Compel, the reinsurance policies obtained by the defendants should be turned over; but plaintiff's request for correspondence is denied. Plaintiff withdraws their motion to compel as it relates to Munich Reinsurance. Counsel are directed to further meet and confer and advise the Court if there are any further issues related to the Reinsurance correspondence matter. With respect to the 165 FOIA request, the Court agrees with the proposed compromise outlined by defense counsel Robert Walsh (see Dkt. 165, pp.2-3). The parties will meet and confer again regarding the discovery of underwriting and claims manuals. IBM agrees to narrow and specify the time frame of said requested manuals. An extension of the deadlines is anticipated, after IMB completes the document share. Counsel shall file a letter request, providing proposed deadlines.
