However, the Court notes sua sponte that Plaintiff Ferrari's Fifth Amended Complaint (Doc. 123) is the operative complaint for all of the consolidated cases in this action. Due to the consolidation of cases 22-cv-2403, 22-cv-2304, and 22-cv-2918, all prior motions were terminated for mootness because an amended pleading ordinarily supersedes the prior pleadings. "The prior pleading is in effect withdrawn as to all matters not restated in the amended pleading, and becomes functus officio." Nisbet v. Van Tuyl, 224 F.2d 66, 71 (7th Cir. 1955).
