ORDER granting in part and denying in part 661 Motion for Hearing. Having considered the parties' submissions, it is hereby ORDERED that the EPPs' motion for an evidentiary hearing regarding class certification is GRANTED IN PART and DENIED IN PART. Without yet deciding the numerous issues in dispute that ultimately will impact the applicability of the anticipated expert testimony, including Takeda's motion to exclude, the Court will permit EPPs to present testimony that they contend is relevant to their motion for class certification, for which EPPs bear the burden of proof. See In re Petrobas Sec., 862 F.3d 250, 260 (2d Cir. 2017). However, the Court finds that the 6-hour evidentiary hearing that the EPPs propose (see EPPs' 5/20/24 Mot. at 1) is beyond what is warranted. Accordingly, as requested by Takeda and agreed to by EPPs, all parties shall meet and confer and, no later than June 17, 2024, submit a joint proposed allocation of time for argument on the three pending motions (i.e., EPPs' motion for class certification, Direct Purchaser Plaintiffs' motion for class certification and Takeda's motion to exclude), as well as testimony from Craft and Takeda's rebuttal witness.
