Inside DOD's New Insider Threat Rule For Cleared Industry
Law360, New York ( June 2, 2016, 11:53 AM EDT) -- Following a series of high-profile espionage cases involving trusted insiders, including contractor personnel, the U.S. government is turning increasingly to private enterprise to support counterintelligence programs. Cleared industry should get ready to implement new industrial security requirements. For example, on May 18, 2016, the U.S. Department of Defense published "Conforming Change 2" to the National Industrial Security Operating Manual (NISPOM). The new rules require every cleared contractor to establish an insider threat program. Cleared contractors should find opportunities to consult with advisers or directly with the Defense Security Service, reporting on implementation and requesting clarification. Key issues include responsibility for compliance costs, employment laws, data privacy, collection and reporting on uncleared U.S. persons, and relevance of unclassified information to insider threat programs....
