DOJ-AmEx Antitrust Trial May Turn On Market Power Question
When the U.S. Department of Justice squares off Monday against American Express Co. for the start of a two-month antitrust trial, the government's case likely will live or die on whether it can prove that the credit card company has the necessary market power to make its anti-steering rules anti-competitive — even though AmEx accounts for just 26 percent of U.S. credit cards.
